At Knytt, we take your privacy very seriously as we know you care about how your personal information is used and shared. By using or accessing the Services in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways.

Remember that your use of Knytt’s Service is at all times subject to the Terms of Service, which incorporates this Privacy Policy.  Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use.

Information Collected

Like many other internet-based services, Knytt needs to collect some information from our users and their usage so we can provide you with the high-quality experience you expect from us. We make every reasonable effort to ensure that our Service(s) are secure and private. The information we collect (directly by us or through trusted third parties, explained below) can be in the following categories:

·  Information Provided by you (at the time of Knytt account creation or while using our Service); 

·  Automatically collected information; and, 

·  Information from other sources.

Information Provided by You

We collect personal information when you register through any of our platforms: website, mobile, or tablet applications (collectively, our “service(s)”, or our “app(s)”). Personal information is any information about you that is personally identifiable—such as your name, address, email address or phone number, third-party sign-in information (for example, your log-in credentials for Facebook, or other third party sites), and any other information that is not otherwise publicly available. If you provide your third-party account credentials to us, you understand some content and/or information in those accounts (“Third Party Account Information”) may be transmitted into your account with us, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy. Certain information may be required to register with us or to take advantage of some of our features.

If you send email invitations to friends or family to join your Knytt network, those email addresses are, in some instances, also collected.

Other information that is stored in our service when either parents, teachers, instructors, coaches, caregivers use our Services, includes but is not limited to: Institute, School, and class information, including name and address, the student(s) name(s) or age(s), as well as the information sent over the service, including messages, announcements, alerts, images, events, or similar.

Some states or local school districts may require administrator approval and access to the data for services teachers or students use. It is the obligation of the teacher signing up for an individual account to obtain those permissions/authorizations. Knytt can provide access to administrators through a school account which they can contact us to create.

Automatically Collected Information

When you use any of our Services, we, or our authorized third party service providers (explained below), may also collect information relating to your devices—including your device type and model, operating system, browser type, unique device identifier, IP address, mobile phone number, location, event information (such as application installations), cookies information, the type of browser you’re using to access our Services, the pages or features you viewed on the service, and the dates and times that you visit, access, or use the service.

Information from Other Sources:

We may also obtain information, including personally identifiable information, from third parties and sources other than the service, such as our partners or other service providers, according to their own policies and terms of use. Through cookies we place on your browser or device, we may collect information about your online activity after you leave our Services.  We may also, at your direction, receive information from third party services that provide a mechanism to expose information you have provided to such third parties through the use of an application program interface (API), e.g. Facebook or  Twitter API. Just like any other usage information we collect, this information allows us to improve the Services and customize your online experience, and otherwise as described in this Privacy Policy.

If we combine or associate information from other sources with personally identifiable information that we collect through the service, we will treat the combined information as personally identifiable information in accordance with this Privacy Policy.

 

Cookies and Similar Technologies

We use Cookies and similar technologies (e.g. pixel tags) to provide you customized and improved user experience. “Cookies” are identifiers we transfer to your browser or device that allow us to recognize your browser or device and tell us how and when pages and features in our Services are visited and by how many people. Like many services, we use these technologies to tailor the Services for you, and to help the Services work better for you – for example, for authentication, security and site integrity, localization, performance analytics, and other features and services. It is possible to delete cookies or prevent cookies from being used in your browser by turning the feature off. If you do so, you may not be able to use features of our service to their full potential.

Also, if you click on a link to a third-party website or service, a third party may also transmit cookies to you.  Again, this Privacy Policy does not cover the use of cookies by any third parties, and we aren’t responsible for their privacy policies and practices.  Please be aware that cookies placed by third parties may continue to track your activities online even after you have left our Services.

We may use this data to customize content for you that we think you might like, based on your usage patterns.  We may also use it to improve the Services – for example, this data can tell us how often users use a particular feature of the Services, and we can use that knowledge to make the Services interesting to as many users as possible.

Authorized Third Parties

We work with third-party vendors, service providers, and other partners to help us provide the best user experience to our users, by performing tasks on our behalf. We may need to share or provide information (including personal information) to them to help them perform these functions, for example: sending emails on our behalf, database management services, database hosting, providing customer support software, and security. These service providers do not have the right to use your personal information we share with them beyond what is necessary to assist us with our business functions. Additionally, these service providers must adhere to confidentiality and security obligations in a way that is consistent with this Privacy Policy.

We may use third-party service providers to serve ads on our behalf across the internet and on our apps. They may collect anonymous information about your visits to our Services and your interaction with our services. They may also use information about your visits to our Services (on websites and mobile applications) to target ads for products and services. For instance, they may collect web log data from you (such as IP address and information about your browser or operating system) or place or recognize a unique cookie on your browser to enable you to receive customized ads. Through this process, demographic or other interest data may be associated with your browser or device in a non-personally identifiable manner. No personally identifiable information is collected in this process.

The free versions of our service may show appropriate “ads” from family-friendly brands and sponsors that help cover the costs to support these free versions of our service. No personally identifiable information is shared with sponsors. Only aggregated, non-personally identifiable information like number of impressions and clicks is sent back for tracking. No advertising from sponsors will be shown to children — only to adults, if at all.

We also work with third-party service providers to monitor certain pages of our website and apps for such purposes as reporting traffic and other advertising statistics. Where authorized by us, these third-party providers may use cookies and/or other monitoring technologies to compile anonymous statistics about our visitors. No personally identifiable information is transferred to these third-party service providers. This information is collected directly by the third party, and Knytt does not participate in that data transmission. Information collected by third parties in this manner is subject to that third party’s own data collection, use, and disclosure policies.

Affiliates

Businesses or third-party websites we’re affiliated with, in certain situations, may sell or provide products or services to you through or in connection with the Services (either alone or jointly with us).  You can recognize when an affiliated business is associated with such a transaction or service, and we will share your Personal Information with that affiliated business only to the extent that it is related to such transaction or service. One such service may include the ability for you to automatically transmit information in your Services profile to your third party account; for example, sharing images to Facebook from the Service or to automatically transmit Third Party Account Information to your Services profile. We have no control over the policies and practices of third party websites or businesses as to privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business’ or websites’ policies.

Use of Information

We use your information for the following general purposes: to operate, maintain, and improve the Services, to contact you, for internal business purposes, and to customize any advertising and content you see in our Service. We use third-party information you provide to us solely to provide services you specifically request. We also use the information that you provide and that we collect to understand and analyze the usage trends and preferences of our users, to improve our product, and to create new features and functionality.

We may use your information to personalize our services, such as remembering your information so that you will not have to re-enter it during your visit or the next time you visit the apps; provide customized advertisements and offer you other relevant products, content, and information; monitor and analyze the effectiveness of our services and third party marketing activities; monitor aggregate site usage metrics such as total number of visitors and pages viewed; and track your entries, submissions, and status in any promotions or other activities.

We will never use children’s personally identifiable information, or collect, use, or share such information for any purposes beyond the authorized purposes determined by the Institution that they belong, or as explicitly authorized by the parent or guardian. We will never target advertisements to children or sell children’s personally identifiable information to third parties for any purpose.

When you invite recipients to join our service, we may contact them regarding our product and service, using an appropriate form of communication. If they would prefer not to receive our communications, they may opt-out using the “Unsubscribe” or “STOP” instructions contained in those communications. We will not use the email addresses that you enter through email invitations, or your address books through any of our apps to send marketing communications to your friends and family, unless they sign up for an account on their own and accept our terms and services.

In some cases, depending on the needs of an Institution using Knytt Services, users may be invited to join that Institution’s group in Knytt and the emails entered in the invitation will automatically be opted-in for communication from that Institute via email. This is done to ensure that users who do not want or know how to create an account in Knytt (e.g. elderly users) do not miss important updates from the Institute. Users can always opt-out by using the “Unsubscribe” instructions in those communications.

Certain user profile information, including your name, location, and any video or image content that such user has uploaded to the Services, may be displayed to other users to facilitate user interaction within the Services or address your request for our services, but not your email addresses or phone number, except to the authorized group administrator(s) from an Institute that you belong to.  Your name and/or username may also be displayed to other users if and when you send messages or comments or upload images or videos through the Services and other users can contact you through messages and comments. Your accounts may also contain a calendar where you can store events and other key dates and details about friends and family. We may send you email reminders of the personalized dates you have entered in this calendar.

You may decline to share certain personally identifiable information with us, in which case we may not be able to provide to you some of the features and functionality of the service. You may update or correct your profile information and preferences at any time by accessing your account preferences page through the service. Please note that while your changes are reflected promptly in active user databases, we may retain all information you submit for a variety of purposes, including backups and archiving, prevention of fraud and abuse, and analytics.

 

Disclosure of Information

We do not sell or disclose your personally identifiable information to nonaffiliated parties except in connection with our Services and the operation of our business as explained in this policy and our terms of service.

We may disclose your personal information in the following ways:

  • Any information that you voluntarily choose to include in a publicly accessible area of the apps, such as a public profile page, will be available to anyone who has access to that content, including other users.

  • We provide personal information to nonaffiliated companies that we engage as contractors or agents to perform services for us, such as administering our websites, systems and software, hosting maintenance, and other such services. These third-party service providers may have access to or process your information to the extent it is necessary for them to complete their contractual obligations to us. Generally, these disclosures are made under terms comparable to this policy, and the recipients are limited to using the information the purpose for which it was provided.

  • We may disclose the information we collect as described above to other companies to: comply with various reporting obligations; for business or marketing purposes; or to assist such parties in understanding our users’ interests, habits, and usage patterns for certain programs, content, services, advertisements, promotions, and/or functionality available through the apps.

  • We may anonymize your Personal Information so that you are not individually identified, and provide that information to our partners. We may also provide aggregate usage information to our partners, who may use such information to understand how often and in what ways people use our Services, so that they, too, can provide you with an optimal online experience. However, we never disclose aggregate usage information to a partner in a manner that would identify you personally, as an individual.

  • In response to subpoenas, court orders, or legal process, from law enforcement agencies or state and federal regulators, or as otherwise required by law;

  • To assert or defend our legal rights, including fraud prevention;

  • To protect the rights, property, or safety of Knytt, our employees, our users, or others;

  • As we deem appropriate to attempt to prevent physical or emotional harm to other persons and/or to their property based on overt or implied threat;

  • In connection with an actual or proposed corporate merger, acquisition, asset purchase, or other transaction or proceeding involving all or part of the business or assets to which the information pertains.

Children’s Privacy & COPPA

As stated in our Terms of Service, you must be at least thirteen (13) years old to use the Service. If you are a child under 13, please do not attempt to register for the Services.

The Children’s Online Privacy Protection Act (“COPPA”) requires that online service providers obtain parental consent before they knowingly collect personally identifiable information online from children who are under 13. We do not knowingly collect or solicit personally identifiable information from children under 13; if you are a child under 13, please do not attempt to register for the Services or send any personal information about yourself to us.  If you believe that a child under 13 may have provided us personal information, please contact us at support@knytt.aws.raiocreative.com. 

We do collect information about children under 13 from their teachers, instructors, caregivers, parents, and/or guardians, but please remember COPPA does not apply to information collected online about children under 13, only information collected from them.

As a parent/guardian, only you and authorized adults within an Institute that child belongs to and is registered for the Services will be able to access your child’s information. Other parents / guardians and adults are not able to see your child’s information. They may be able to see User Submissions related to your child if they are submitted in a group posting (e.g. when a photo involving your child is shared to a group or sub-group).

Data Security Safeguards:

We are committed to protecting your data and information in our Service. We use certain technical, physical, and managerial safeguards that are designed to improve the security and integrity of your information. Your account is protected by a password for your privacy and security. As is the case with other online services, however, we cannot ensure or warrant the security of any information you transmit to us or store on the apps and you do so at your own risk. We also cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. If we learn of a security systems breach, then we will attempt to notify you electronically and post a notice in our app so that you can take appropriate protective steps.

Similarly, although we may allow you to adjust your privacy settings to limit access to your information, please be aware that no security measures are perfect or impenetrable. We cannot control the actions of other users with whom you may choose to share your information. Therefore, we cannot and do not guarantee that information you post on the apps will not be viewed by unauthorized persons. We are not responsible for circumvention of any privacy settings or security measures contained on the service. You understand and acknowledge that, even after removal, copies of information that you have posted may remain viewable in cached and archived pages or if other users have copied or stored such information.

Your account is protected by a password for your privacy and security.  You are responsible for preventing unauthorized access to your account and Personal Information by selecting and protecting your password appropriately.

Changes to Privacy Policy

As we constantly continue to improve our Service to serve your better, we may need to change this Privacy Policy from time to time and publish updated Policy on this page. In the event that the modifications materially alter your rights or obligations hereunder, we will make reasonable efforts to notify you of the change via email, if we have one on file, or generate a pop-up or similar notification when you access the Service for the first time after such material changes are made. Our amended Privacy Policy will automatically take effect immediately after it is made available through our Service. If you do not agree with any changes to the Privacy Policy, you may terminate your account and stop using the Service. Your continued use of the Service after the revised Privacy Policy has become effective indicates that you have read, understood and agreed to the current version of the Privacy Policy.
